Our Team

LING LAY CHOON

LL.B (Hons) Malaya – Managing Partner

Ms. Ling Lay Choon is our principal partner and the founder of the firm. She holds a degree in the Bachelor of Laws (Honour) from the University of Malaya and was called to the Malaysian Bar in Year 1999. During her many years of practice, Ms. Ling has attended to various sale and purchase agreements for various types of properties (residential, commercial and industrial) including project sale and sub-sale. She has experiences advising clients range from individuals to financial institutions, developers and big corporations.

Ms Ling specialises mainly in banking and real estate transactions. In banking portfolio, she acts for local and foreign financial institutions in advising of security documents for both conventional and Islamic facilities. Her experience in property matters also includes drafting and advisory work relating to the acquisition, disposal and leasing of residential and commercial properties and obtaining the requisite approvals from the regulatory bodies.

Besides her vast experience in handling various conveyancing matters, Ms. Ling is also well versed in general litigation include civil, bankruptcy and winding-up actions, family law matters (matrimonial law, probate matters and letters of administration).

Possessing a “nothing is impossible” spirit, Ms Ling will approach each case expediently and competently with an aim of getting a fair and just result.

LING LAY KEONG

LL.B (Hons) Malaya – Partner

Ms. Ling Lay Keong is the partner of the firm. She was called to the Malaysian Bar as an Advocates & Solicitors of the High Court of Malaya in 1999 and has been very active in all the litigation matters since then.

Lay Keong is very familiar with court proceedings and regularly appears in the Lower Courts, High Court, and the Appellate Courts. Having passion for civil litigation, Lay Keong’s principal area of practice include accidents and personal injury matters, banking and insolvency matters, matrimonial and family matters, debt recovery, probate and administration and some other commercial disputes.

Besides attending to court matters, Lay Keong also possesses vast experiences in real estate transactions and preparation of security documents for various financial institutions including conventional and Islamic loan documentation for local and foreign financial institutions.

LING XIN JING

LLB (Hons) UKM - Partner

Xin Jing was admitted to the Malaysian Bar as an Advocates & Solicitors of the High Court of Malaya in 2018 and has been very active in both litigation and conveyancing matters since then.

Xin Jing is known and well regarded to be a legal practitioner who is solution oriented and result driven. She is also a gregarious and efficient person who is used to dealing with high turnaround demands.

Trustworthy, committed, proactive and hardworking, Xin Jing has earned a solid reputation among clients for being calm, understanding and highly competent, with a vast in-depth knowledge of her area of practice and has developed an unwavering passion and respect for a career in law.

WYNNE NG ENG YEE

LLB (Hons) MMU - Legal Assistant

Wynne was called to the Malaysian Bar as an Advocates & Solicitors of the High Court of Malaya in July 2022.

As an enthusiastic young practitioner, Wynne is optimism in becoming a valuable asset to the firm. Her portfolio in the legal field includes the acquisitions and dispositions of property, perfection, tenancies and preparation of security documents for various financial institutions including conventional and Islamic loan documentation for local and foreign financial institutions including CIMB Bank Berhad, Hong Leong Bank Berhad, Public Bank Berhad and RHB Bank Berhad.

Over and above her practice and experience in conveyancing matters, Wynne is also attending to court matters and familiar with family law matters of Matrimonial Law, Child Adoption matters, Probate Matters and Letters of Administration.

Wynne is now focusing and extending her knowledge in many areas of law, supplementing the needs of the firm from time to time.

Divorce


There are two types of divorce process (for non-Muslims) in Malaysia:
(1)Divorce by Mutual Consent (Joint Petition) - Both parties to the marriage can jointly file a divorce where they can mutually agree to divorce.
(2) Divorce Without Mutual Consent (Unilateral/ Single Petition) - Either party to a marriage may file a petition to divorce without consent of the other party, on the ground that the marriage has broken down.

A Joint Petition for divorce takes around 5 to 6 months to be completed. A Single Petition takes more time to be completed and could take more time if contested.

A petition for divorce whether it is contested or not contested may be done only after two years of marriage. If a petition is presented before the expiration of two years, then there must be exceptional circumstances or hardship suffered by the petitioner for the Courts to consider whether to grant such decree for divorce.

It is not mandatory for a couple to live separately for 2 years before they can file for divorce. However, if a couple lives separately for at least 2 years, this will count towards ‘proof of irretrievable breakdown’ as a ground for divorce if a single petition (contested divorce) is filed in Court. There is no such requirement in a joint petition.

A foreign divorce certificate can be recognised in Malaysia by filing a petition in court to recognise the foreign divorce certificate



Child Adoption


There are two ways to make an application for adoption:-
a. Registration with the National Registration Department (NRD) under Registration of Adoption Act 1952 (applicable for Muslims & Non-Muslims). Under this application, the child must be in the custody of the adoptive parents for at least two years ; and
b. Application through the Court process under the Adoption Act 1952 (only applicable for Non-Muslims). After 3 months of caring for the adoptive child, the adoptive parent(s) can apply to the court through a lawyer for an adoption order.

Yes. You can apply to the court for the change of surname during adoption process.

No. one of the main requirements for an adoption application is the birth certificate. If the child was born in this country but is without a birth certificate, then the application for the late registration of birth must be made first.

Yes, provided that the child has fulfilled the normal period of residence as required under the Registration of Adoption Act and has a valid travel document before making the adoption application.

A child adopted under the Adoption Act is legally considered a child born to the adoptive parents in lawful wedlock. Upon an adoption order being made, all rights, duties, obligations and liabilities of the birth parents, in relation to the future custody, maintenance and education of the adopted child shall vest in and be exercisable by and enforceable against the adoptive parents as though the adopted child was a child born to the adoptive parents in lawful wedlock. The right to inheritance under the Wills Act 1959 and the Distribution Act 1958 is also transferred from the birth parents to the adoptive parents.
